Terms and Conditions

Welcome to OurCast Live. These Terms and Conditions (“Terms”) govern your use of the OurCast Live mobile applications, website, and related services (“Services”) provided by OurCast Live, Inc. (“we,” “us,” “our”). By downloading, accessing, or using OurCast Live, you agree to these Terms. If you do not agree, please do not use our Services.

1. Eligibility

You must be at least 13 years old to use OurCast Live. If you are under 18, you must have parental consent.

2. Account Registration

Certain features (such as hosting broadcasts or enterprise accounts) require registration. You must provide accurate and complete information and are responsible for maintaining the confidentiality of your account credentials.

3. Use of Services

Broadcasting: Hosts may create live audio broadcasts. You are responsible for ensuring you have the rights to any content you broadcast.

Listening: Audience members may join broadcasts using their own devices.

AI Enhancements & Translation: Where available, AI-powered noise suppression, voice clarity, and real-time translations are provided on an “as-is” basis. Performance may vary depending on network conditions and third-party providers.

Restrictions: You may not use OurCast Live to share unlawful, offensive, or infringing content, or to interfere with the normal functioning of the platform.

4. Payments & Subscriptions

• Free users may access limited features.

• Paid and Enterprise accounts require subscriptions processed through Stripe on the web portal. In-app purchases for digital services are not available.

• Overages for streaming or translation credits are billed automatically through Stripe.

• All payments are non-refundable except as required by law.
  
  

5. Intellectual Property

All intellectual property related to OurCast Live (software, trademarks, content, logos) is owned by OurCast Live, Inc. or its licensors. You may not copy, modify, or distribute our content without prior written consent.

6. User Content

By broadcasting or uploading content, you grant OurCast Live a limited license to transmit and display that content for the purpose of operating the Services. You retain ownership of your content.

7. Data & Privacy

Our use of personal data is governed by our Privacy Policy. By using OurCast Live, you consent to such data collection and use.

8. Service Availability

We aim to provide reliable, low-latency services but cannot guarantee uninterrupted or error-free performance. We are not liable for disruptions caused by internet providers, device limitations, or third-party platforms (e.g., Agora, Stripe, Firebase).

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or misuse our Services.

10. Disclaimer & Limitation of Liability

OurCast Live is provided “as-is.” We disclaim all warranties to the maximum extent permitted by law. We are not responsible for indirect damages such as loss of data, business interruption, or missed broadcasts.

11. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
